Using a case study to illustrate the issues, this panel will explore EU initiatives to promote private enforcement of competition law; developments in the UK, Germany, the Netherlands and Denmark; comparisons with the US; the role of arbitration; issues around forum selection; pass on/causation and quantification; and litigation insurance/funding including success fees and the German/Dutch “claims bundling” model (effectively a contingency fee arrangement).
